SHIPPING POLICY

Alcohol products purchased from Badlands Distillery (hereinafter “Badlands”) are sold in Alberta. Title passes to the purchaser at the time of purchase. After that, Badlands does not own the product and is only arranging shipment on the purchaser’s instructions.

Packaging and shipping are done on behalf of the purchaser, at the purchaser’s request and under the purchaser’s direction. By entering a shipping address and completing the order, the purchaser is instructing Badlands where to send the purchaser’s product.

Badlands makes no representation of the legal rights of purchasers to import alcohol into any province or territory outside of Alberta. It is solely the purchaser who is responsible for the shipment or importation of alcoholic products, and for all costs associated with that transmission, including taxes, markups, deposits, duties, or tariffs imposed by regulatory authorities.

Where we ship
We ship within Canada to provinces and territories where we are permitted to deliver alcohol, excluding Quebec.

We accept orders only for delivery to destinations we are permitted to serve. We may refuse, cancel, or refund any order if we reasonably believe shipment would not comply with Alberta law or the laws of the destination province or territory.

Excluded destinations and buyer-directed shipment
Checkout and carrier services are set to prevent shipment to excluded destinations, including Quebec. If an order is placed, routed, or delivered to an excluded address because the purchaser entered a false, incomplete, or misleading address, used a freight forwarder, parcel locker, third-party receiver, or otherwise manipulated shipping or checkout, that is done solely by the purchaser.

In that case:

  • the purchaser—not Badlands—is instructing and directing the shipment;
  • the purchaser is solely responsible for the shipment, importation, and any breach of destination law;
  • Badlands is not the importer and accepts no liability for taxes, markups, seizures, penalties, refusal of delivery, or loss;
  • Badlands may cancel the order, refuse to reship, or refund less outbound shipping and related costs, at its discretion.

Platform and shipping settings
Our store runs on Shopify. Shipping zones, checkout rules, and provincial restrictions are configured to exclude destinations we do not serve, including Quebec. Shopify, apps, and carrier tools are updated regularly. Those updates can reset, override, or change shipping settings without notice.

If an update, app change, or system error allows an order to an excluded or restricted province to go through, that does not mean we agreed to ship there. The purchaser remains solely responsible for the destination they entered. We may cancel the order, stop the shipment, or refund less outbound shipping and related costs once we discover it.

Fulfillment
Addresses and destinations are not individually reviewed by staff on every order. Checkout, shipping zones, and address or fraud tools—including software and automated or AI-assisted systems—are relied on to apply our restrictions.

The purchaser is responsible for the accuracy of the address and destination they enter. Automated processing is not a legal review of the destination and is not approval to ship to an excluded province. If an order to an excluded or restricted destination is accepted in error, we may cancel it, stop shipment, or refund less outbound shipping and related costs when we become aware of it.

Who may order
Orders are for personal, household use only. We do not sell through this website to restaurants, bars, retailers, or other commercial resellers. We may limit quantities. 

By placing an order, the purchaser represents and warrants that:

  • they are of legal drinking age in the destination province or territory;
  • the shipping address is their own residential address for personal, household use;
  • they are not ordering for resale, a business, a licensee, or another person;
  • the destination is one we are permitted to serve;
  • they will not use a false address, freight forwarder, parcel locker, third-party receiver, or any other method to reach a province or territory we exclude or are not permitted to serve, including Quebec;
  • they will pay all destination taxes, markups, deposits, duties, and carrier charges that apply after title has passed.

If any representation is false, the purchaser is in breach and is solely responsible for the shipment and for any regulatory, tax, or legal consequence.

No licence outside Alberta
Badlands is an Alberta producer. This website is not an offer to sell alcohol under the liquor laws of any other province or territory. Completing an order does not make Badlands a retailer, importer, or licensee in the destination.

Compliance and refusal
We may request government photo ID, refuse or cancel an order, limit quantity, or refuse a replacement shipment if we reasonably believe the purchaser is underage; the address is commercial, a forwarder, or not the purchaser’s residence; the order is for resale; or shipment would not comply with Alberta law or the law of the destination. We may also cancel orders when destination rules change.

Taxes and destination charges
Product price is the Alberta sale price unless a destination charge is shown at checkout. Any markup, tax, deposit, or fee imposed by a destination authority is the purchaser’s responsibility and may be collected and remitted as that authority requires. Shipping is arranged for the purchaser and is separate from the sale of the alcohol.

Delivery and age
Delivery requires proof of age (signature on delivery where the carrier offers that option). You must be of legal drinking age in the destination province or territory to receive the order.

Damaged, undelivered, or returned orders
Notwithstanding the passing of title, we will replace or refund orders that arrive damaged or that are not delivered, on the terms set out in our Refund Policy. Orders that cannot be delivered, that are refused, that are seized, or that are returned because of an incorrect, excluded, or ineligible address may be refunded less outbound shipping and related costs, or reshipped at the purchaser’s expense, at our discretion. Carriers are independent contractors.

Limitation of liability
To the fullest extent permitted by law, Badlands is not liable for indirect, incidental, special, or consequential loss, or for fines, markups, taxes, seizure, or inability to import arising from the purchaser’s choice of destination, from a platform or settings change, from automated processing, or from a breach of these terms. Our total liability for a shipment is limited to the amount the purchaser paid for that order, except where we agree to replace or refund damaged or undelivered goods under our Refund Policy.

Indemnity
The purchaser will indemnify and hold harmless Badlands, its owners, and its staff from claims, penalties, taxes, markups, and costs (including reasonable legal fees) arising from shipment or attempted shipment to an excluded or unpermitted destination, false address or age information, resale or commercial use, or the purchaser’s importation of the product into another province or territory.

Governing law
This policy and the purchase are governed by the laws of Alberta and the federal laws of Canada applicable there. Courts of Alberta have exclusive jurisdiction, except where a destination statute requires otherwise.

Changes
We may update this policy at any time. The version in effect when the order is placed applies to that order.
